Franchisor / Franchisee Leases

These leasing arrangements are considerably different than traditional retail leasing situations. Typically, the franchisor or master franchisee will negotiate the lease with the landlord and will be the tenant. These leases will always have the right to sublet the premises as the franchisor/master franchisee will be subletting the premises to the franchisee who will occupy the space as a subtenant. The franchisor and the franchisee will each have their own priorities when negotiation the head lease and sublease while the head landlord will always have their own priorities as well.
