Ground Leases, Building Leases and Solar Roof-Top Leases

At Davidzon Law our commercial lease experience goes beyond more traditional forms of commercial leases. We have represented clients in all manner of leases and these include ground leases, building leases and solar roof-top leases. These are forms of leases with their own particular set of considerations and issues. Ground leases can be for vacant properties or can be for developed properties but include additional obligations on behalf of the tenant. Building leases are different that traditional leases in that the tenant assumes a greater amount of control and responsibility over the structures located on the property. With the introduction of Ontario’s Green Energy Act a new industry of solar roof-top leasing has sprung up with company securing rights to commercial roof-tops to install solar panels. These are highly specific leases and generally include a time period following which the property owner receives title to the solar installation. Solar roof-top leases are highly particular and issues such as access, maintenance and control all need to adequately addressed. With several years of experience dealing with such leases, we know exactly what to look for and what to do.
